Terms of Service

By registering for an account on this system I hereby agree to the following.

1. ACCURATE INFORMATION

   "The information that I submit shall be true, accurate and complete to the best of my knowledge.

2. AUTHORITY

   Each party represents and warrants that it is a legal business entity duly organized and validly existing in good standing under the laws of the jurisdiction of its formation, and that it has full power and authority to enter into and perform this Agreement. I am authorized by my company or organization to submit data.

3. LIMITATION OF LIABILITY

   IN NO EVENT WILL COMPANALYSIS BE LIABLE FOR ANY DAMAGES, WHETHER FOR TORT OR CONTRACT, INCLUDING LOSS OF DATA, LOST PROFITS, OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES RISING OUT OF PARTICIPATION IN THIS SURVEY.

4. GOVERNING LAW

   This Agreement shall be governed by and construed according to the laws of California without regard to its conflict of law provisions. Any disputes arising under or related in any way to this Agreement shall be brought in a federal or state court of competent jurisdiction in Alameda County, California, and in no other jurisdiction. The parties hereby consent to such jurisdiction and hereby waive any claim or defense that such forum is not convenient or proper.

5. COMPLETE AGREEMENT

   This Agreement contains the complete agreement between the parties with respect to participation in the SURVEY. If a court of competent jurisdiction holds any part of this Agreement invalid or unenforceable, the remainder of the Agreement shall be interpreted so as to reasonably reflect the intention of the parties.

   I acknowledge that I have read and accepted the terms of this Agreement and that I have the authority to enter into this agreement on behalf of my company.
